April

• Federal Judge Vacates Affordable Care Act (ACA) Preventive Care Coverage
  • Judge O’Connor’s ruling states that health plans cannot be required to cover the services with an A or B rating recommended by the U.S. Preventive Services Task Force after the passage of the ACA free of charge.
• Employer Plan Guidance Issued on the End of the COVID-19 Emergency Periods
  • On April 10, 2023, President Biden signed H.J. Res. 7 into law, thereby ending the national state of emergency related to COVID-19 that was declared under the National Emergencies Act.
• Guidance Issued on Gag Clause Prohibitions Under CAA
  • One of the lesser-known parts of the CAA, 21 is the prohibition on “gag clauses” within provider agreements that restrict access to price and quality information. 
• Departments Issue FAQs Clarifying COVID-19 Coverage and Payment Requirements
  • On March 29, 2023, the Departments issued FAQs to clarify how the COVID-19 coverage and payment requirements under the FFCRA and CARES Act will change when the PHE ends.

• 2024 Limits Announced for HSAs, High Deductible Health Plans, and Excepted Benefit HRAs
  • On May 16, 2023, the IRS released updates to the maximum annual 2024 contribution limits for HSAs under high deductible health plans.

June

• IRS Reminds Plan Sponsors of Cafeteria Plan Claims Substantiation Requirements
  • If claims are improperly substantiated, any contributions participants make into these reimbursement accounts can lose their tax-favored status and may instead become subject to taxation as gross income for participants.
• IRS Confirms Certain “Wellness” Programs Cannot Be Used to Avoid Taxation
  • In a memo released on June 9, 2023, the IRS Office of Chief Counsel indicated that this strategy is too good to be true, concluding that fixed indemnity plans cannot be used to avoid taxation if the employee does not have unreimbursed medical expenses related to the payment.
• Updated 720 Forms for PCORI Filings Due July 31, 2023
  • An updated 720 Form has just been released by the IRS for submitting the latest PCORI payments by the due date of July 31, 2023 for policy years and plan years ending on or after October 1, 2022.
• IRS Publishes Additional Guidance for HDHPs on COVID-19 Preventive Care
  • The IRS published additional guidance modifying the COVID-19 coverage that high deductible health plans (HDHPs) can provide while maintaining their HSA-qualified status.
