• Biden Administration Plans to End COVID-19 Public Health Emergency in May

  • The Biden Administration announced on Monday January 30, 2023 that the COVID-19 public health emergency, which has been in place since January 2020, is set to end on May 11, 2023.

• Telehealth Relief Included in End-Of-Year Omnibus Bill

  • While the Consolidated Appropriations Act, 2023 (CAA23) does not include as many health provisions as the CAA of 2021, it does include the anticipated relief on telehealth coverage offered through qualified High Deductible Health Plans (HDHPs) that pair with Health Savings Accounts (HSAs).

• Impact of Planned End of COVID-19 Emergency Periods on Employer Health Plans
  • For employer plan sponsors, the end of the COVID-19 outbreak period will mean the return of many critical timeframes postponed due to the pandemic.
• Federal Action Temporarily Halts Surprise Billing Arbitration Decisions
  • Recent federal court action put a halt to part of the final rules governing the arbitration process for federal surprise billing disputes between healthcare providers and group health plans and health insurance issuers.
• New Rule Requires Electronic Information Reporting for Most Businesses
  • On February 23, 2023, the IRS issued a final regulation that requires electronic form filing for common employer form series.
• Data Collection Requirements by Carrier | Prescription Drug Data Collection Reporting Submissions
  • Prescription Drug Data Collection (RxDC) reporting for reference year 2022 is required to be submitted no later than June 1, 2023.

• CMS Waivers, Flexibilities, and the Transition Forward from the COVID-19 Public Health Emergency
  • The Centers for Medicare & Medicaid Services are preparing for the end of the Public Health Emergency for COVID-19 on May, 11, 2023.
• 2024 Employer Mandate Penalties Released
  • Failure to comply with certain Affordable Care Act requirements can lead to employer shared responsibility or “employer mandate” tax penalties.
• CMS Publishes 2022 RxDC Reporting Instructions
  • RxDC is the new federal health and prescription drug claims and plan spending reporting requirement that affects employer group health benefit plans of all sizes and funding structures. Calendar year 2022 reports are due by June 1, 2023.
• Departments Issue FAQs Clarifying COVID-19 Coverage & Payment Requirements
  • On March 29, 2023, the Departments issued FAQs to clarify how the COVID-19 coverage and payment requirements under the FFCRA and CARES Act will change when the PHE ends.
