New Requirements for Brokers Assisting With ACA Consumer Plans

Every broker assisting consumer clients needs to obtain and document the consumer’s consent before facilitating them with enrollment or applying for a subsidy through the Marketplace.
These new requirements are a part of the Centers for Medicare and Medicaid Services (CMS) final rule for the
HHS Notice of Benefit and Payment Parameters for 2024, effective June 18, 2023.
Consent can be provided and documented in one of the following ways:
- Writing
- Electronically via email
- Or call/voice recording
The documentation of consent must include the date the consent was given, the name of the consumer or their authorized representative, and the name of the agent, broker or agency in which consent is being granted to. Documentation must be stored securely for 10 years and can be rescinded by the client at any time.
