Delaware Annual Behavioral Health Well Check Required Starting 1/1/24
Starting January 1, 2024, the Delaware law requires coverage of an annual behavioral health well check with a licensed mental health clinician.

Delaware House Bill 303, as amended by House Amendment 2, was signed into law on August 3, 2022 and includes requirements that become effective on January 1, 2024. Starting January 1, 2024, the law requires coverage of an annual behavioral health well check with a licensed mental health clinician with at minimum a masters level degree, using the diagnosis of “annual behavioral health well check.”
Such coverage is in addition to an annual preventive office visit with a medical care provider. The law requires carriers to provide pre-deductible coverage for an annual* behavioral health well check and requires this coverage for fully-insured individual, fully-insured group, State of Delaware Employee Group Health Insurance Program, and State Medicaid assistance plans.
The well check must include a review of medical history, evaluation of adverse childhood experiences and use of a group of developmentally appropriate mental health screening tools.
