April

• Biden-Harris Administration Proposes Solution to Family Glitch

  • The Biden-Harris Administration announced that it would release a proposed rule to fix the family glitch.

• Proposed Regulations Issued to Substantially Increase Access to Federally Subsidized Health Insurance

  • On April 5, 2022, the Biden-Harris Administration issued new proposed regulations changing certain aspects of the affordability and minimum value rules under the Affordable Care Act.

• Health and Human Services Extends Public Health Emergency Until July 16, 2022

  • On April 13, 2022, the Secretary of Health and Human Services (HHS) renewed the COVID-19 pandemic Public Health Emergency effective April 16, 2022.

• 2023 Limits Announced for High Deductible Health Plans and Health Savings Accounts
  • The Internal Revenue Service released updates to the maximum annual 2023 contribution limits for health savings accounts (HSAs) under high deductible health plans (HDHPs).

June

• Reminder: PCORI Fees Due August 1, 2022
  • Patient-Centered Outcomes Research Institute (PCORI) fees for plan years that ended in 2021 are due August 1, 2022. 
• CMS Releases FAQs on Individual-Market Broker Compensation
  • CMS released a new FAQ document clarifying that a health insurance issuer cannot treat commissions on enrollments during a SEP differently than commissions on enrollments during the OEP.
• U.S. Supreme Court Overturns Roe v. Wade
  • The U.S. Supreme Court officially reversed Roe v. Wade on Friday, June 24th, declaring that the constitutional right to abortion upheld for nearly half a century, no longer exists.
• Implications of Abortion Decision for Employee Benefits
  • The recent U.S. Supreme Court's decision to overturn Roe v. Wade raised many questions for employee benefit plan sponsors that may take months or even years to fully resolve. However, existing law does help to answer certain key questions. 

Pennslyvania

June

• Philadelphia Employee Commuter Transit Benefit Program
  • On June 9, 2022, the Philadelphia City Council passed an ordinance that would require certain employers to make available to eligible employees a commuter transit benefit program. The bill was signed into law by the Mayor on June 22, 2022.

Delaware

May

• Delaware Passes Paid Family and Medical Leave Law
  • Delaware has enacted the HealthyDelaware Families Act, requiring job-protected, paid family and medical leave for Delaware employees.

Maryland

April

• Maryland Passes Mandatory Paid Leave Law
  • This program will provide for up to 12 weeks of paid leave for all employees in the State who meet minimum eligibility criteria.
